Who may use the Site

You must be at least 16 to use the Site, and at least 18 (or the age of majority where you live) to make a purchase through any link on it. By using the Site you confirm that you meet these requirements.

• impersonate anyone, or submit someone else’s personal information without their permission;
• send spam, automated requests, scrapers or bots, or get around rate limits, code words or other access controls;
• interfere with the Site’s security or operation, or reverse-engineer it;
• share or publish promo codes or code words in a way the issuing brand does not allow;
• use the Site for anything illegal.

We may remove content, block access or end conversations that break these rules.

Your questions and messages

When you send a question through Ask Evelyss, a message through Talk, or any comment or suggestion to us (“Submissions”), you give the House of EVELYSS a worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to use, reproduce, show, quote, edit, adapt, publish and distribute your Submission and the name you provided, in any media, including in Ms. Evelyss’s videos, posts, magazine and guides, and to use Submissions to improve her answers. You will not be paid for Submissions.

You confirm that your Submission is your own, that it does not break any law or anyone’s rights, and that you are happy for the name you gave to appear on screen. Please do not put private or sensitive information in a Submission. We are not obliged to answer, publish or keep any Submission.

Ms. Evelyss is an AI-generated character. Her images, videos, voice and written answers are produced with AI. Talk replies are written by AI live and are not reviewed before you see them. AI can be wrong, out of date or incomplete. See our AI Disclosure.

EVELYSS™, Ms. Evelyss, her name, character, persona, likeness, appearance, voice, personality, catchphrases, images, videos, the magazine, guides, written content, logos, design and all other content on the Site are owned by or licensed to the House of EVELYSS and protected by copyright, trademark, right of publicity and other laws.

You may view and share links to the Site for your own personal, non-commercial use, and share our posts using the platforms’ own share features. Press may use the photos offered on our Press page with the credit given there. Otherwise, you may not copy, sell, modify or use our content without written permission.

No training, no deepfakes. You may not use Ms. Evelyss’s likeness, voice, images, videos or text to train, fine-tune or prompt any AI or machine-learning model, create a digital replica, voice clone or deepfake of her, or make content that suggests she said, did or endorsed something she did not.

Links, shopping and promo codes

The Site links to retailers and other sites we do not control. Purchases are between you and the seller, on the seller’s terms. Prices, stock and offers can change. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF ONE HUNDRED US DOLLARS (US$100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM. Indemnity

You agree to defend, indemnify and hold harmless the House of EVELYSS and its owners, officers, employees, contractors and partners from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site, your Submissions, your breach of these terms, or your violation of any law or anyone else’s rights. We may take over the defence of any such claim, and you will cooperate with us.

Governing law

These terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. If you are a consumer living in the UK or EU, you also keep any protections of your local law that cannot be waived.

Disputes

Talk to us first. Before filing any claim, email hello@evelyss.com with a description of the issue. We will try in good faith to resolve it within 60 days.

Courts. If it is not resolved, any claim must be brought only in the state or federal courts located in Maricopa County, Arizona, and you and we consent to their jurisdiction and venue. Either party may bring an eligible claim in small claims court.

Class-action waiver. To the fullest extent allowed by law, claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative action.

Time limit. To the extent allowed by law, any claim must be brought within one year after it arises.

Changes

We may update these terms. The date at the top shows the latest version. If you keep using the Site after a change, you accept the updated terms. We may also change, pause or stop any part of the Site at any time.

Termination

We may suspend or end your access to all or part of the Site at any time, for any reason, including a breach of these terms. The sections on submissions, ownership, disclaimers, limitation of liability, indemnity, governing law and disputes survive termination.

Severability and entire agreement

If any part of these terms is found unenforceable, the rest stays in effect, and that part is enforced as far as allowed. Our failure to enforce a term is not a waiver. These terms, together with our Privacy Policy, Affiliate Disclosure, AI Disclosure and, for interviewers, our Interview Terms, are the entire agreement between you and us about the Site. You may not transfer your rights under these terms; we may transfer ours.
